Australian Business Lawyers and the Workplace Research Centre at the University of Sydney are proud to present our Enterprise Agreement Making course for 2010.  This essential one-day program aims to furnish you with all the fundamentals as you gear up for the forthcoming collective bargaining round.

Legal aspects & strategic overview   (AM session)

 

The first half of this full-day program will present the building blocks necessary for striking an Enterprise Agreement (EA). Detailed information will be provided about the mandatory processes required to comply with current legislation - when initiating bargaining, during the negotiation phase, surrounding industrial action and when drafting your agreement for ratification.  Complementary discussion will centre on negotiating in good faith, union involvement in agreement-making, and seeking or defending bargaining orders before Fair Work Australia and the courts.  Significant, recent case law will be explored.

 

Learning outcomes:

  • The fundamentals of making an enterprise agreement;
  • The legal requirements to negotiate and draft an agreement and the process for approval;
  • Good faith bargaining and union involvement in agreement making.

 

Strategic planning & negotiation skills

The second half of the program builds on the earlier legal foundations via an interactive workshop.  While you may approach bargaining in the anticipation it can be concluded collaboratively, without resort to external intervention by Fair Work Australia or others, it pays to plan ahead.  During the afternoon there will be an opportunity to develop negotiation skills via group role play.  You will additionally undertake an exercise to analyse the key challenges associated with planning, then implementing your organisation's EA bargaining strategy. 

 

The day will conclude with a comprehensive review session.  This will be an ideal opportunity to seek answers to any outstanding queries you have relating to legal or other challenges you face with your forthcoming enterprise agreement.

  • What to research, how to obtain support from management, communication strategies with employees and others, and how to prepare for industrial action;
  • How to prepare for and commence bargaining;

Sharlene is an experienced advocate and advises clients in many areas of industrial relations and employment law, including industrial disputes, enterprise agreements, underpayment claims, breach of contract claims, discrimination complaints and unfair and unlawful dismissals. Sharlene provides strategic advice to employers in relation to managing workplace change, including advice in the areas of restructuring, redundancies, drafting and implementing policies and employment contracts.

Seymour's background in human resource management has included roles with a strong IR and employee relations focus, as well as more generalist HR responsibilities. He has extensive experience working in private, not-for-profit and public sectors, in Europe and in Australia, including in strategy & management consulting, government, employment assistance, manufacturing, equity & disability and tertiary education. Seymour's professional passion is devising highly experiential and applied learning and development programs.
